Terms of Service

Official operating protocols for Diaz Sheet Metal, LLC.

1. Professional Engagement

These Terms of Service govern all professional interactions, services, and products provided by Diaz Sheet Metal, LLC ("the Company"). By engaging our services for HVAC, Plumbing, or Fabrication projects, you ("the Client") agree to these conditions in their entirety.

2. Operations & Site Safety

Normal Business Hours

Monday–Friday, 7:00 AM to 4:00 PM. Work performed outside these hours at the Client's request is subject to emergency/overtime rates.

Hazardous Materials

DSM will not handle or disturb asbestos, lead paint, or toxic substances. Work will cease immediately if such materials are suspected until remediation is complete.

3. HVAC & Mechanical Services

Design Standards: HVAC systems are sized and designed based on Manual J/S calculations and manufacturer specifications.
Maintenance Prerequisite: Equipment warranties are contingent upon the Client performing regular seasonal maintenance (filter changes, coil cleaning) by a licensed technician.
Thermostat Programming: Basic user training is provided at installation; however, ongoing programming is the Client's responsibility.

4. Plumbing Support Protocols

All plumbing work adheres to Maryland Plumbing Code. Key limitations include:

Existing Pipe Integrity: DSM is not responsible for leaks or failures in existing plumbing lines that were not modified or replaced during our scope of work.
Drain Cleaning: Clogs cleared by DSM are warranted for 24 hours only, as subsequent blockage depends on Client usage and system age.

5. Ductwork Fabrication Policy

Standards of Production

All ductwork and fittings will be fabricated based strictly on:

Blueprints provided by the Client
Verified field dimensions
Shop drawings approved by the Client

Approval Workflow

Diaz Sheet Metal will submit shop or fabrication drawings for review. Formal written approval authorizes production. Any subsequent changes may incur additional costs and delivery adjustments.

Company Errors

DSM will correct or replace affected pieces due to company error within a reasonable and mutually agreed timeframe.

Third-Party/Client Errors

Refabrication costs are the Client's responsibility if errors arise from incorrect third-party dimensions, undisclosed site conditions, or post-approval changes.

Delivery timelines depend on material availability and timely client approvals. DSM makes commercially reasonable efforts to meet schedules but is not liable for indirect damages, consequential delays, or operational losses derived from factors outside its control.

6. Compliance & Financials

Permits & Fees

Municipal fees and permit costs are the Client's responsibility. DSM will assist in filing, but fees are billed directly or reimbursed by the Client.

Financial Terms

A 50% mobilization deposit is required for equipment/custom orders. Balances past 15 days trigger work stoppage and possible Mechanic's Lien action.

7. Warranty & Jurisdiction

New installations include a 1-year DSM labor warranty. Disputes are governed by the laws of the State of Maryland, with mediation required in Prince George's County prior to litigation.
